Make sure your legacy is protected

It is important to protect your legacy and your dependants should the unexpected happen.  The backbone of your succession plan is your will.

75% of South Africans die without a valid last will and testament causing devastating consequences for their families and dependents.

1. Cost of Dying

Most people are aware that life cover is needed but many fail to plan for legal expenses that the Estate incurs when they die – such as the Executor, Trustee, and Conveyancing fees.  Without a will and appointed executor, the government is essentially in control of the process.

2. Financial provision for your family

This goes beyond simply taking out life cover.  You may need to consider using Trust structures to ensure you protect your minor children or spouse’s inheritance.  A partner may be left without nothing if you are not married, or your will is not updated from a previous marriage.

3. Who looks after your children when you no longer can?

What happens when both spouses die? What about single-parent homes? What about families separated by country of residence? Who would you appoint as the legal guardian of your beloved children?  Your children’s inheritance could pass to the Government Guardian’s Fund.

4. Taxes

Most married individuals leave their entire Estate to their Spouse, but if both of you die and your children inherit everything then Capital Gains Tax and other legal fees are triggered.

5. Inheritances and Heirlooms

You will forfeit the opportunity to decide who inherits what and your estate is distributed according to South African law.  This means people whom you may not have wanted to benefit from your Estate may inherit your assets and family heirlooms.  It is normally the first thing people think about – who gets what.  It is not only about distributing your assets, it is about clearly, logically, and lovingly protecting your legacy and your memory.
